Philip Morris Suing Retailers


Philip Morris USA, a division of Altria Group, Inc. and the nation’s largest cigarette manufacturer, has filed suit in federal court against 10 New York and New Jersey retailers alleging that they sold counterfeit Marlboro cigarettes. The action is part of Philip Morris’ continuing battle against the sale of fake Marlboro cigarettes. Since May 2009 Philip Morris has sued 27 retail outlets in New York and New Jersey.

Philip Morris states that the sale of counterfeit cigarettes not only robs them of sales but damages their flagship Marlboro brand. Philip Morris also points out that they are not the only ones being harmed since the sale of illegal cigarettes cheats federal, state, and local governments out of valuable tax revenue and unfairly punishes honest businesses selling legitimate Marlboros. New York and New Jersey are fertile markets for fake cigarettes due to a combination of high taxes, organized criminal wholesalers and an abundance of small, independent retailers.

Philip Morris’ lawsuit is requesting that the retailers relinquish all profits from the sale of the counterfeit cigarettes as well as legal costs and punitive damages.

    Wake up America!! Counterfeit Marlboro cigs have been bouncing around for several years. You can usually tell by smoking one. Harsh taste or unusual buzz. Sometimes fake Marlboro packs come in smaller sizes. Sometimes they are made for export to other countries and are also made in other countries for export to ours. STOP CIGARETTE TAX.
