Stern’s lawyer explained the suit, filed in New York State’s Supreme Court, was triggered by the failure of SiriusXM to award the shock jock’s contribution to the company’s exceeded growth targets in subscribers since 2006.

Reports state that before 2006 Stern did receive stock options. According to SiriusXM, it “met all our obligations under the terms of our 2004 agreement with Howard, his agent and production company.” They also said the lawsuit left them, “surprised and disappointed.” SiriusXM recently signed Stern to a second five-year contract.

The suit was filed on Tuesday in New York and alleges that Sirius paid the stock bonus in 2006, but has failed to do so in the years following.

Stern alleges that the bonus should have been triggered each years that Sirius added two million new subscribers, a number which was reached every year since 2006.

Despite the conflict, stern signed a new deal with Sirius in December that will keep him there through 2015.

The reduction in the overall value of the contract is tied to stock prices. In addition Stern could regain more value if incentives are hit. Earlier this week Stern stated that he would not take any pay cuts on his radio program.

Today he changed course by saying the contract was fair and that he is pleased with it. Executives at Sirius XM also expressed satisfaction with the deal. Stern has not yet disclosed any specifics about his new deal with the company.

He made the announcement on Thursday, but did not give up any details on the amount SiriusXM agreed to pay to keep him on the air.

Stern has been with the satellite radio company since December 2005 on a five year contract worth $500 million. In the past several months, Stern has openly said he would require a much higher contract to sign on.

He threatened to return to regular radio, and was rumored over the past week to be trying to work with Itunes on a contract to provide a daily Podcast.

Cummings has participated in several of the career tributes, including the roast of Joan Rivers. She has worked as a model in the past and was a cast participant on MTV’s ‘Punk’d.’

Stern’s contract ending has brought a lot of speculation as to what will happen with him and the rest of the crew after December 2010.

One speculation is that Stern would go back to “terrestrial radio” and to radio conglomerate Clear Channel. Stern however has not speculated that he would go back to regular radio. In fact he has rallied against the decision. Since his move to Sirius Satellite Radio was caused in part because of the treatment that he received while on regular free radio, it is hard to imagine Howard Stern going back.

On January 26, 2010, Stern mentioned that he could not imagine going back to terrestrial radio, stating, “Once you come here, it very difficult to imagine going back”. For the most part Sirius has allowed Stern to run the kind of radio show that he wanted to run. It has been uncensored and no holds barred.

A move back to terrestrial radio would put more rules and constrictions on the show.

As of this time it is hard to say what will happen at the end of the year, we will have to keep listening to find out.

Lange has been absent from the radio show in recent weeks, having left on an indefinite hiatus earlier in December.

When Stern originally signed his contract with Sirius in 2006, they wanted his brand name and popularity so badly that they promised him $500 million in stocks and cash. But Sirius is experienced financial trouble this year, nearly filing for bankruptcy, so the outrageous paycheck Stern received before is more than likely going to be reduced quite a bit this time around. For this reason, the radio personality is threatening to leave Sirius behind and not renew his contract, unless the payout is worth his time.

Analysts are predicting that all of this commotion and threatening is only to negotiate a better contract, but that Stern would more than likely stay with the company, since it’s a greater chance of his voice being heard, and without censoring. Talk is floating around, however, of Stern possibly taking his show to a subscription-only service for mobile phones or PCs, instead of sticking it out with Sirius.
