Kelly Rutherford To Fight Custody Ruling

Actress Kelly Rutherford of “Gossip Girl” fame has lost the most recent battle against her ex-husband regarding custody of the couple’s two children. A judge recently ruled that ex-husband Daniel Giersch, who lives in Monaco with daughter Helena,7, and son Hermes,4, will no longer be responsible for paying for the children to visit with their mother in the United States. Rutherford was extremely upset by the judge’s latest decision and issued a statement indicating that she will continue to fight for primary custody of her youngsters.

Rutherford said she considers the judge’s ruling tantamount to allowing American children to be deported from their native country. She also said the recent ruling amounts of a punishment that neither the 45-year old actress nor her children deserve and that despite their father not being an American citizen, the courts ruled in his favor. With her legal fees mounting over her continuing custody battles with Giersch, Rutherford decided to file for bankruptcy protection earlier this year. Based in New York City, she says that she plans on travelling to France before Christmas in order to personally escort both of her children back to the Big Apple so they can spend time with mom.
